Probate is simply the legal process of dealing with someone\u2019s estate after they die. It is often less complicated than it sounds — but knowing the order of things helps.

What probate is

It is the formal authority — given by the court — for someone (usually the executor named in the will, or a close relative if there is no will) to manage the deceased’s estate.

When it is needed

Most banks need probate before they release funds above a certain threshold (usually £15,000–£50,000). It is also required for selling property or shares held in the deceased’s sole name.

Doing it yourself versus a solicitor

For straightforward estates, many families apply for probate themselves through the government website. For complex estates — multiple properties, businesses, overseas assets — a solicitor is usually worth the cost.

There is no rush. Probate can take months — that is normal.
